Terms of Service for Openhouse

1. Acceptance of Terms

By using the App, you agree to be bound by these Terms, our Privacy Policy, and any other guidelines or policies incorporated by reference. We reserve the right to modify these Terms at any time, and any changes will be effective upon posting on the App. It is your responsibility to review these Terms periodically.

2. Use of the App

You may use the App for lawful purposes only and in accordance with these Terms. You agree not to:

  • Post any illegal, harmful, or infringing content.
  • Impersonate any person or entity or mislead others regarding the identity or affiliation with any person or entity.
  • Use the App for any fraudulent or deceptive activities.
  • Violate any applicable local, state, or international laws or regulations.

3. Property Listings

The App displays properties available for sale or rent in Morocco, which may include apartments, garages, studios, villas, land, and houses. Sellers and landlords ("Users") submit their listings on the App. However, we verify the information provided by the sellers/landlords through direct checks and documentation, and we sign contracts with them to confirm the accuracy of the listings.

While we make efforts to ensure that the listings are accurate, it is ultimately the responsibility of the buyer/renter to verify any additional details related to the property.

4. User Registration and Account

To use certain features of the App, you may be required to create an account. By registering, you agree to provide accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Notify us immediately of any unauthorized use of your account.

5. Transactions and Payments

The App serves as a platform to connect buyers and sellers. All payments for the purchase or rental of properties are handled directly between the buyer and seller/landlord through cash or bank transfers. We do not facilitate payment processing or act as an intermediary in the transaction.

Please ensure that any financial transactions are handled securely and responsibly. We are not responsible for any payment disputes or issues arising from transactions between users.

6. Dispute Resolution

In the event of any issues after a property purchase or rental (such as dissatisfaction with the property), responsibility falls on the buyer and seller/landlord/renter or rentee. We do not mediate or intervene in post-purchase or post-rental disputes.

7. Limitation of Liability

To the fullest extent permitted by law, we disclaim any and all liability for damages or losses resulting from:

  • Errors or inaccuracies in the property listings.
  • Any disputes or transactions between users.
  • Interruptions or issues with the functionality of the App.
  • Unauthorized access to or use of your personal information.

We do not provide warranties for the properties listed or guarantee any outcomes of the transactions. Our service is solely to facilitate the connection between buyers and sellers.

8. No Warranty

The App and its contents are provided "as is" and "as available" without any warranties, express or implied. We do not guarantee that the App will be uninterrupted, error-free, or free of viruses or other harmful components. We disclaim any warranties, including but not limited to implied warranties of merchantability and fitness for a particular purpose.

9. Termination

We reserve the right to suspend or terminate your access to the App at any time, without notice, for any reason, including violations of these Terms. Upon termination, all rights and obligations that have accrued before termination will survive.

10. Governing Law

These Terms are governed by and construed in accordance with the laws of Morocco. Any disputes arising under or in connection with these Terms shall be resolved in the courts of Morocco.

11. Indemnification

You agree to indemnify, defend, and hold harmless Openhouse, its affiliates, employees, agents, and third parties from any claims, damages, obligations, losses, liabilities, costs, or expenses arising from your use of the App, your violation of these Terms, or your violation of any rights of a third party.

12. Privacy Policy

By using the App, you consent to the collection, use, and disclosure of your personal information in accordance with our Privacy Policy. We take privacy seriously and will not share your data with any third parties. Sensitive data, such as passwords, is securely encrypted end-to-end in our database using bcrypt technology. 13. Changes to Terms of Service

We reserve the right to update or modify these Terms at any time, and such changes will be effective immediately upon posting on the App. You are encouraged to review these Terms regularly to stay informed of any changes.
